Relocation

Florida Statute 61.13001 defines relocation as a change in location of the principal residence of a parent at the time of the last order establishing or modifying timesharing of at least 50 miles.

If a parent seeks relocation, they must file a petition to relocate and serve it on the other parent.  Petitions to relocate are very technical and require precise legalese and specific information to be done successfully.

Similarly, the Court will determine whether to approve relocation petitions based on the best interest of the child standard.  In particular, courts will examine (among other factors):

(1) the nature, quality, extent of involvement, and duration of child’s relationship with both parents;

(2) the likely impact the relocation will affect the child’s physical, educational, and emotional development;

(3) the feasibility of preserving the relationship between the non-relocating parent;

(4) the child’s preference [where age appropriate]; and

(5) whether the relocation enhances the child’s quality of life.
